I. Data processing on our Website
We constantly endeavour to improve our website to facilitate your visits. That is why we use cookies to obtain specific data of the visitors to our website.

III. Data processing within the framework of the pension fund contract
APK Pensionskasse AG is authorised to operate a pension fund on account of a licence granted by the Financial Markets Supervisory Authority (FMA).
Data secrecy
APK Pensionskasse AG contractually binds it staff, as well as any data processors it employs, to secrecy regarding any data resulting from data processing entrusted or made accessible to them strictly in the context of their professional activities. This does not apply if there is a legally admissible reason for transferring such data entrusted or made available.
Personal data
APK Pensionskasse AG processes the following personal data of beneficiaries (entitled and recipient) on the basis of the details provided by you or the contribution-paying enterprise – to the extent that they are required for processing your entitlements: title, name, address, social security number and personnel number, nationality, gender, marital status, date of birth, rank, date of joining, contributions, income (only in cases of increased risk protection), termination of the employment relationship, and the bank details as well as names, addresses, dates of birth and social security numbers of entitled dependants.
Legal foundation and purpose of processing
APK Pensionskasse gathers and processes your personal data in accordance with labour law provisions regarding incorporation into a pension fund agreement or a pension fund contract.
In order to be able to fully comply with contractual and statutory obligations (pursuant to the Pension Fund Act), it is necessary to obtain the data from you or your employer. They are processed for the purpose of taking into deposit, and investing, pension fund contributions, administering and determining entitlements, as well as providing relevant information about these issues.
Necessity for processing your personal data
The provision of your personal data, including, on occasion, the data of third parties named by you, is required for substantiating and assessing your claims vis-à-vis the APK Pensionskasse AG. In the absence of these data, we may not be able to substantiate our contractual relationship with you or meet your benefit claims. Please note that this would not constitute non-fulfilment of contractual obligations on our part.
Recipients
Within the APK Pensionskasse, personal data are transferred to the extent necessary for discharging our contractual, statutory and regulatory obligations. To the extent that data transfer is necessary for complying with a contract, expedient or mandatory, the pension fund transfers personal data to external recipients, such as processors (printers, etc.) or regulatory and financial authorities. Beyond that, they are also transferred to other retirement provision institutions in compliance with admissible official directions. Processors in receipt of your personal data are contractually bound to treat these data as confidential and to process them strictly within their contractual remit.
Retention of your personal data
As a matter of principle, we retain your data for the duration of the contractual relationship. Beyond that, we are subject to a multitude of data storage provisions obliging us to retain personal data relating to you, to third parties (such as dependants), or to your benefit event, beyond the termination of the contractual relationship, e.g. in accordance with company law-based retention periods. We will also retain your data for as long as it is permissible to assert legal claims for your benefit, based on the contractual relationship.
Your rights (data subject rights)
Right to access
Having furnished proof of your identity, you can send a written request for information about all processed data concerning your person to the APK Pensionskasse AG (See contacts, Item IV). If no data concerning the person requesting information are being processed, s/he will be informed of this fact (negative reply). In cases of legitimate interests on the part of the provider of information / third party (for instance to prevent or prosecute criminal offences) no details might be furnished.
Right to rectification or erasure
APK Pensionskasse AG constantly endeavours to keep its data up to date. Having furnished proof of identity, you can request in writing that any inaccurate data relating to your person, or data processed in contravention the Data Protection Act, be rectified or erased. For economic and administrative reasons, such erasure / rectification may only be possible at certain points in time.
Right to object
Provided we are in receipt of, and process, your personal data by your consent, you are entitled to withdraw your consent at any time with the effect that, as soon as we receive your withdrawal of consent, we will not process your data any longer for the purposes listed in your note of consent.
Right to restriction of processing:
Under certain conditions, if you have asserted this right, APK is entitled only to store your personal data but not to do any further processing.
Right to data portability:
You are entitled to request transfer of a copy of all your personal data, processed by the APK Pensionskasse AG by means of automated procedures, in a standardised machine-readable format.
Right to lodge a complaint with the Data Protection Agency
